1. About these terms
These Terms of Service ("Terms") govern your use of createABA.com.au ("the Service"), operated by the owner of createABA.com.au ("we", "us", or "our"). By using the Service you agree to these Terms. If you do not agree, please stop using the Service.
These Terms are governed by the laws of Australia. Where you are a "consumer" within the meaning of the Competition and Consumer Act 2010 (Cth) Schedule 2 (Australian Consumer Law), nothing in these Terms limits, excludes or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
2. The Service
createABA converts CSV spreadsheets into ABA batch payment files entirely within your web browser. No financial data is transmitted to our servers at any point.
The Service is provided for the purpose of generating ABA files for upload to Australian bank internet banking portals. It is not a payment processor, financial institution, or licensed financial services provider.
3. No warranty on ABA file accuracy
We make reasonable efforts to generate ABA files that comply with the Australian Payments Network (APN) file format specification. However:
- Bank acceptance criteria vary. Some banks require additional formatting (for example, Westpac may require a self-balancing entry). We cannot guarantee that every generated file will be accepted by every bank.
- The accuracy of any generated file depends entirely on the accuracy of the CSV data you supply. We do not verify BSB numbers against live bank records, validate account names, or confirm that payees exist.
- You are solely responsible for reviewing every ABA file before uploading it to your bank. A malformed or incorrectly populated file may result in payments being rejected, delayed, sent to the wrong account, or processed for the wrong amount.
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranty of any kind. We do not warrant that the Service will meet your requirements, be error-free, or produce files that any particular bank will accept.
Nothing in this clause excludes any guarantee implied by the Australian Consumer Law that cannot be excluded (for example, the guarantee that services will be rendered with due care and skill). Where such a guarantee applies and a remedy is available, our liability is limited to re-supplying the service or paying the cost of having the service re-supplied, at our election.
4. Your responsibilities
You are responsible for:
- Ensuring all payment data in your CSV is correct before generating an ABA file.
- Reviewing the generated ABA file against your source data before uploading it to your bank.
- Obtaining any required authorisations under your organisation's internal controls before submitting batch payments.
- Complying with all applicable laws, including the Payment Systems (Regulation) Act 1998 (Cth), your bank's terms and conditions, and any ATO or payroll obligations.
- Keeping your account credentials confidential if you have a Pro account.
5. Limitation of liability
To the maximum extent permitted by law, we are not liable for any loss or damage arising from your use of the Service, including but not limited to:
- Incorrect, duplicate, or misdirected payments.
- Bank rejection of generated ABA files.
- Loss of data or business interruption.
- Any indirect, incidental, special, or consequential loss.
Our total aggregate liability to you for any claim under these Terms is limited to the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.
6. Pro subscription and billing
The Pro plan is billed monthly via Stripe. Prices are in Australian dollars (AUD) and include GST where applicable.
Free trial. New Pro subscribers receive a 30-day free trial. You will not be charged until the trial period ends. You may cancel at any time before the trial ends without being charged.
Cancellation. You may cancel your Pro subscription at any time via the Account page (Manage Billing). Cancellation takes effect at the end of your current billing period — you will retain Pro access until then. We do not provide partial-month refunds.
Refunds. If you believe you are entitled to a refund under the Australian Consumer Law (for example, because the Service has a major failure), please contact us at support@createaba.com.au .
Price changes. We may change the subscription price with 30 days' notice by email to your registered address. If you do not accept the new price, you may cancel before it takes effect.
7. Privacy
Your privacy is important to us. All CSV and payment data is processed entirely in your browser and is never transmitted to our servers. Please see our Privacy Policy for full details of how we handle personal information.
8. Intellectual property
The Service, including its software, design, and content, is owned by us and is protected by Australian copyright law and international treaties. You may not copy, reproduce, or create derivative works from any part of the Service without our written permission.
You retain all rights in the CSV files and payment data you supply. You grant us no licence over that data — we do not store or access it.
9. Acceptable use
You must not use the Service to:
- Generate ABA files for fraudulent, unlawful, or unauthorised payments.
- Attempt to reverse-engineer, scrape, or systematically extract data from the Service.
- Interfere with or disrupt the Service's infrastructure.
- Resell or sublicence access to the Service without written permission.
We reserve the right to suspend or terminate your account immediately if we believe you are violating this clause.
10. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email (if you have a Pro account) or by posting a notice on the Service. Continued use of the Service after the effective date of any change constitutes your acceptance of the updated Terms.
11. Governing law and disputes
These Terms are governed by the laws of Australia. Any dispute that cannot be resolved informally will be referred to the courts of Australia. Nothing in this clause affects any rights you may have under the Australian Consumer Law.
